By visiting www.pcna.com/en-us or www.pcna.com/en-ca and Polyconcept North America's (together with Polyconcept North America's affiliates, "PCNA") other affiliated websites (the "Websites"), you agree to abide by the Terms of Use described below. We have created these rules and guidelines to protect you and to ensure that the Websites are safe for everybody. By agreeing to these terms, you are taking responsibility for your own actions. If you do not agree to the terms of use below, please do not access or use this site.

PCNA obtains all information, downloadable files and software contained herein from sources believed by PCNA to be accurate and reliable. Because of the possibility of human and mechanical error as well as other factors, PCNA shall not be held responsible for any errors or omissions in the information, and/or downloadable files, and/or software available at the Websites. PCNA makes no representations, and expressly disclaims all responsibilities, about the suitability, for any purpose, of the information, downloadable files and/or software that are available to the user at the Websites. control of PCNA. PCNA is not, and shall not be, held responsible for the contents, in any way or form, of any linked site or of any link contained in a linked site. PCNA provides these links only as a convenience to you, the user of the Websites; and the inclusion of any link does not imply endorsement by PCNA 
of the linked site.

Any rights not expressly granted by PCNA herein are expressly reserved.


Web Site Terms of Use

Acceptance of Terms of Use of the Websites: The access to the Websites is provided free of charge to you by PCNA under these Terms of Use. Although portions of the Websites may be viewed simply by visiting such Website, in order to receive additional services from PCNA you may need to sign on as a guest or register as a member of such Website. If you sign on to the Websites as a guest or if you register as a member of the Websites' community, these Terms of Use will govern your use of the Websites, including access to message boards and other features.

Please check this area before using the Websites to determine whether a change has been made to these Terms of Use. Use of Cookies

When you visit the Websites, you can surf the site anonymously and access important information without revealing your identity. In order to analyze and improve our site, PCNA uses "cookies" to track your visit. A cookie is small amount of data that is transferred to your browser by a Web server and can only be read by the server that gave it to you. It cannot be executed as code or deliver viruses. Most browsers are initially set to accept cookies. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. (For some Web pages that require an authorization, cookies are not optional. Users choosing not to accept cookies will not be able to access those pages.) Modifications of these Terms of Use

PCNA may modify these Terms of Use from time to time at its sole discretion. Each time you log on to the Websites, you will be deemed to have accepted any such changes, unless you arrange to terminate your registration with the Websites immediately (i) by notifying PCNA of your unwillingness to accept the changes to the Terms of Use; and (ii) by discontinuing your use of the Websites.


Modifications of the Websites

PCNA may modify or discontinue the Websites with or without notice to you and without liability to you or to any third party.


Content of Messages

You also agree not to use the Websites to send or post on message boards or any place on the Websites, any message or material that is unlawful, harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, threatening, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation, or encourage the use of controlled substances. 

PCNA reserves the right to delete any such material from the Websites. PCNA will cooperate fully with any law enforcement officials and/or agencies in the investigation of any person or persons who violate the Terms of Use contained in this Section. You agree not to post or use the Websites to distribute or send any illegal material of any kind, including but not limited to, illegal material in the form of text, graphics, video, programs or audio files. Posting content or participating in any form of discussion with the intention to commit any illegal activity is strictly prohibited. 
 
You acknowledge that (i) PCNA permits access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights"); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, the Terms of Use and applicable copyright, trademark and other laws govern your use of such content. You may not post to the Websites, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material subject to any Rights. The burden of determining that Rights do not protect any information, software, images or any other content on the Websites rests with you. You acknowledge that PCNA may acquire Rights to use any posted materials as described below, and that you will not acquire any of those Rights by downloading such materials.

PCNA IS NOT RESPONSIBLE FOR THE CONTENT ON THE INTERNET OR WORLD WIDE WEB PAGES THAT IS CONTAINED OUTSIDE THE WEBSITE. AS A CONVENIENCE TO THE WEBSITES' USERS, PCNA MAY PROVIDE LINKS TO RESOURCES THAT ARE BEYOND PCNA'S CONTROL. Promotional Messages​​

PCNA may, from time to time, send email messages to you containing advertisements, promotions, etc. PCNA makes no representation or warranty with respect to the content of any such email messages or services that may be obtained from PCNA, and you agree that PCNA shall not have any liability with respect thereto.


Indemnification

You agree to indemnify and hold each officer and/or employee of PCNA, its parent companies, subsidiaries and affiliates, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Websites, the violation of these Terms of Use by you, or the infringement by you, or any other user of your account, of any intellectual property or other right of any person or entity.


Applicable Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflicts of laws provisions thereof. The sole jurisdiction and venue for actions related to the subject matter hereof shall be Pennsylvania State and U.S. Federal courts sitting in the County of Allegheny. In any action or proceeding to enforce rights under this Agreement, the prevailing party will be entitled to recover costs and attorneys' fees.


Remedies for Breach of These Terms by You​​

In the event that PCNA determines, at its sole discretion, that you have breached any portion of these Terms of Use, or have otherwise demonstrated conduct inappropriate for the community of the Websites, PCNA reserves the right to (i) warn you via email that you have violated these Terms of Use; (ii) delete any content provided by you or your agent(s) to the Websites, (iii) delete all content provided by you to the Websites, (iv) discontinue your registration with the Websites; (v) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities for further action; and/or (vi) any other action which PCNA deems to be appropriate. ​​


Miscellaneous

In the event that any provision of the Terms of Use conflicts with the law under which the Terms of Use are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to the Terms of Use, such provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law, and the remainder of these Terms of Use will remain in full force and effect. The failure of either party to insist upon or enforce strict performance by the other party of any provision of the Terms of Use or to exercise any right under the Terms of Use will not be construed as a waiver or relinquishment to any extent of such party's right to assert or rely upon any such provision or right in that or any other instance, rather, the same will be and remain in full force and effect. 
 
PCNA may assign its rights and obligations under these Terms of Use and upon such assignment PCNA may be relieved of any further obligation hereunder. You represent to PCNA that you have the authority to register with the Websites according to these Terms of Use. 
 
These Terms of Use and any Additional Terms constitute the entire understanding between the parties as to the subject matter herein, and supersede all prior agreements and understandings. Any legally unenforceable provision of these Terms of Use will, at the election of PCNA, be deleted or modified to correct the defect and, regardless, the remainder of the terms of these Terms of Use will remain valid and enforceable. ​

Online Pricing Policy

Effective February 16, 2015

In order to protect the quality image of the products sold under the Polyconcept North America's ("PCNA") affiliated companies Leedsworld, Bullet Line, and Journalbooks (each a “PCNA Company”, and collectively the “PCNA Companies”) as well as PCNA's licensed brand names (“PCNA's Licensed Brand(s)”), and to maintain consistency among all PCNA brands and PCNA's Licensed Brands (collectively, the "Brands"), the PCNA Companies are reissuing their Policy for Online Advertising from April 14, 2014, such reissuance to be effective as of February 16, 2015 (the "Policy").


For the purposes of this Policy, PCNA's Licensed Brands include: Aladdin®, Alicia Klein®, Arctic Zone® Balmain®, California Innovations®, Case Logic®, Cool Gear®, Cross®, Cutter & Buck®, Disrupt®, elleven®, Field & Co.®, Griffin®, High Sierra®, Hunt Valley®, JournalBooks, Kenneth Cole Reaction®, Laguiole®, Luxe®, Neotec®, ProTowels®, Safety Works®, Scripto®, Slazenger®, StrombergBrand®, Thule®, Wenger®, Woolrich®, Zippo®, and Zoom®. This Policy also extends to any new PCNA's Licensed Brands as they may be introduced to the PCNA product line in the future. All other products in the PCNA product line are considered PCNA products.


The Policy is as follows:


1. The PCNA Companies will sell products only to those Distributors or qualified Resellers who, in the sole discretion of the PCNA Companies, do not diminish or otherwise harm any of the Brands. The following are examples of conduct that the PCNA Companies believe diminish the Brands:

a. advertising or marketing any of the Brands in any way that disparages, misrepresents or injures any Brand; and/or


b. advertising or marketing products through online or print advertising methods at deeply discounted prices (e.g., discounted more than 10% (for PCNA's Licensed Brand products) or 20% (for any other PCNA Company’s brand products)) from the applicable company's lowest published coded catalog prices at the applicable company’s highest published catalog quantities or temporarily reduced promotional prices; and/or


c. using any Brand products in any illegal, deceptive, undesirable, or improper advertising, marketing or selling practice, including predatory or “loss leader” pricing, bait and switch, or negative selling practices.



2. The Brand products are for sale only through the promotional products industry. They are not intended for sale through electronic retail channels (i.e. eBay, Amazon.com, etc.).



This Policy represents each PCNA Company's unilateral statement of its intent in selling, or continuing to sell, its respective products, and is not a contract for the sale of products, nor an offer to form a contract. The PCNA Companies are not asking for, and will not accept, any agreement about a Distributor’s compliance with this Policy. Rather, this Policy reflects the PCNA Companies’ decision on how to best to advertise and market their respective products, including the decision to sell to only those Distributors who are committed to furthering the Brands, and appropriate product positioning.



If a PCNA Company discovers a Distributor engaging in any practice inconsistent with this Policy, it may unilaterally decide, in its sole discretion, to terminate its business relationship with that Distributor in whole or in part. Each PCNA Company reserves the right, in its sole discretion, to choose those Distributors with whom it will do business for Brand products.



Except as specifically authorized by a PCNA Company, PCNA Company sales representatives are strictly prohibited from discussing this Policy or any advertising, pricing, or product positioning practice with any Distributor, and from seeking or accepting any assurance of compliance with this Policy. All questions regarding this Policy shall be directed, in writing, to adpolicy@polyconceptna.com with "Policy for Online Advertising" in the subject line.



The PCNA Companies do not seek any comments from any Distributor about the advertising, pricing, or product positioning practices of any other Distributor. Further, the PCNA Companies will not, under any circumstances, discuss the business dealings of any Distributor with any other Distributor. The PCNA Companies reserve the right to change, amend, or discontinue this Policy at any time.

Privacy Policy

Polyconcept North America (and its affiliated companies, Leedsworld, Bullet Line, and Journal​books) (collectively, "PCNA")believes in and respects your privacy and the sanctity of information that may be provided. In the course of using PCNA as a preferred supplier, use of our web site and in responding to our surveys, you may have the opportunity to voluntarily submit personally identifiable information (e.g., providing profile information or providing an e-mail address). By participating in a survey or in visiting our Web site, you understand and consent to this policy.


When you access the Internet, the computers that host Web sites you visit (Web servers) automatically receive some anonymous information. This "usage data" may include a record of which pages a Web browser has visited. PCNA's servers receive usage data when customers visit our web site. PCNA may use various kinds of software devices to collect information about Internet use. Small files called "cookies" may be attached to your Web browser. These files identify your browser and may save information such as passwords so that Web sites can recognize you when you return. You can set your browser to disable cookies, but some web sites may not work properly if you do this. In addition, some web sites use small bits of code called "one-pixel gifs," or "clear gifs" embedded in some Web pages, to make cookies more effective.


We take every precaution to protect our customer information and do not utilize personal or company information for anything other than internal purposes to provide and improve service levels. We are sensitive to the privacy and security of your personal information. However, we cannot guarantee absolute security as such information may be transmitted using the Internet, other public telecommunication networks, servers, hardware or software ("systems") that are not owned, operated, or controlled by us. Except as described in this policy, PCNA will not sell, trade, or disclose to third parties outside of PCNA and its affiliates, any customer identifiable information, including customer names and addresses, without the consent of the customer (except as required by subpoena, search warrant, or other legal process or in the case of imminent physical harm to the customer or others). When PCNA uses other agents, contractors or companies to perform services on its behalf, PCNA will ensure that the company protects your customer identifiable information consistent with this Policy.


PCNA reserves the right to modify this policy at any time without notice other than posting on this site. ​



Legal Requirements For California

Product Safety Statement Concerning Polyconcept North America's (and its affiliated companies, Leedsworld, Bullet Line, and Journalbooks) (collectively, "PCNA") Products and California Proposition 65 Chemicals

PCNA's products meet all applicable federal safety and warning requirements as enforced by the U.S. Food and Drug Administration, the Consumer Product Safety Commission, and the Federal Communications Commission. PCNA's products that are shipped to California are also subject to Proposition 65, otherwise known as the Safe Drinking Water and Toxic Enforcement Act of 1986. Proposition 65 requires consumer product warnings for products shipped to California that contain chemicals known to the state of California to include carcinogens or reproductive toxins unless such chemicals are present below established Safe Harbor Levels or are shown to be present in unharmful concentrations.


Decorating and printing inks used on PCNA's products that are decorated in the USA have been fully tested and do not contain chemicals at concentrations that would require a Proposition 65 warning label. Safe Harbor Level limits have not been fully established by Proposition 65 for all materials used in PCNA's products, however we may be able to offer, upon request, certification of independently tested concentrations of specific chemicals for specific products.


To better serve our distributors, and assist them in complying with Prop 65 requirements, distributors must request that the following Proposition 65 warning be applied to their products prior to shipment:


WARNING: This Product may contain chemicals known to the state of California to cause cancer,
birth defects or other reproductive harm.


This warning label will ensure compliance with California Proposition 65 regulatory requirements, and can be applied for an additional cost of $0.13 (v) per item. Labels will only be applied when requested specifically by the distributor.
